1. Agreement to Terms

By accessing and using Geckistry.com (the “Site”), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

Geckistry specializes in the breeding and sale of crested geckos and Leachianus geckos, as well as related supplies and feeders. All sales are conducted in accordance with applicable federal, state, and local laws governing the sale of live animals.

2. Live Animal Sales Terms

2.1 Legal Requirements

By purchasing live animals from Geckistry, you confirm that:

• You are at least 18 years of age
• It is legal to own the species being purchased in your jurisdiction
• You have obtained any necessary permits or licenses required in your area
• You will provide proper care and housing for the animal

2.2 Animal Health and Wellness

All geckos sold by Geckistry are:

• Captive bred on our premises
• Feeding consistently on appropriate diet
• Visually inspected for health prior to shipment
• Packaged safely and humanely for transport

2.3 Shipping and Delivery

Live animal shipping is subject to our Shipping Policy. Key requirements include:

• FedEx Priority Overnight shipping with FedEx hub pickup only
• Weather-dependent shipping (no extreme temperatures)
• Monday through Wednesday shipping to avoid weekend delays
• Customer must pick up within 2 hours of delivery notification

2.4 Live Arrival Guarantee

We guarantee live arrival of all geckos when the following conditions are met:

• Animal is picked up at FedEx hub within 2 hours of delivery notification
• Customer immediately notifies us with photo/video evidence of any issues
• Weather conditions were safe at time of shipment
• Shipment was not refused, abandoned, or returned

If a gecko arrives deceased (DOA) and all conditions are met, we will offer a replacement of equal value or full refund at our discretion. Claims must be made within 2 hours of pickup.

3. Refunds and Returns

3.1 Live Animals

Due to the living nature of our products:

• No refunds or returns on live animals after pickup except as outlined in our Live Arrival Guarantee
• All sales are final once the animal is in your possession and confirmed healthy
• We do not accept returns for buyer's remorse, change of mind, or incompatibility with existing animals

3.2 Products and Supplies

Non-living products (feeders, cultures, supplies, equipment):

• May be returned within 14 days of delivery if unopened and in original condition
• Customer is responsible for return shipping costs
• Refunds will be issued to original payment method minus original shipping costs
• Live cultures and feeders are non-returnable once received

4. Payment and Pricing

Payment is required in full at time of purchase. We accept major credit cards, debit cards, and other payment methods as indicated at checkout through our secure payment processor (Stripe).

All prices are in U.S. Dollars and subject to change without notice. Prices include the animal or product only; shipping costs are calculated separately at checkout based on destination and item type.

For live animal orders, we may place a hold on your payment until the animal is shipped. You will not be charged until we confirm a safe shipping date.

5. Health and Care Disclaimer

While we guarantee our geckos are healthy at the time of shipment, we cannot guarantee their health after delivery. Proper care, housing, temperature, humidity, and diet are the responsibility of the buyer.

We are not responsible for:

• Illness, injury, or death occurring after delivery and acceptance
• Health issues resulting from improper care, housing, or handling
• Incompatibility with other animals in buyer's collection
• Veterinary costs incurred after delivery
• Genetic traits or morphs that develop differently than expected as animal matures

We strongly recommend researching proper gecko care before purchasing. We are available to answer care questions but are not liable for health issues resulting from buyer error.

6. Breeding and Genetics

While we make every effort to accurately identify and represent the genetics and morphs of our geckos, we cannot guarantee:

• Future offspring production or breeding success
• Exact color development or pattern as animal matures
• Hidden genetic traits that may affect offspring
• Gender accuracy for animals under 3 months old

Color and pattern descriptions are our best assessment at time of sale. Crested and Leachianus geckos can change significantly as they mature.

7. Limitation of Liability

To the maximum extent permitted by law, Geckistry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use our products or services
• Any conduct or content of any third party related to our services
• Unauthorized access, use, or alteration of your transmissions or content
• Shipping delays, carrier errors, or weather-related delays

In no event shall our total liability exceed the amount paid for the specific product or animal in question.

8. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of the site after changes constitutes acceptance of the modified terms.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States and the state in which Geckistry operates, without regard to conflict of law provisions.
